Most recently, the various state codes of judicial conduct have come under attack through litigation challenges. While the stated goal of the codes is admirable, their end result is often destructive to core liberties of speech, association, petitioning, and due process secured under the Constitution.

8.2 Judicial Officials  A lawyer shall not make a statement that the lawyer knows to be false or with reckless disregard as to its truth or falsity concerning the qualifications or integrity of a judge or other judicial officer 

8.3  Reporting Misconduct  

(a) A lawyer having reliable information that another  lawyer has committed a violation of the rules of Professional Conduct that raises a substantial question as to that lawyer's honesty, the trustworthiness of fitness to practice law shall inform the appropriate professional authority  

(b)  A lawyer having reliable information that the Judge has committed a violation of applicable rules of judicial conduct that raises a substantial question as to the judge’s fitness for office shall inform the appropriate authority.  

(c ) If a lawyer serving as a third-party neutral receives reliable information during the dispute resolution process that another lawyer has engaged in misconduct which the lawyer would otherwise be required to report but for its confidential nature, the lawyer shall attempt to obtain the parties’ written agreement to waive confidentiality and permit disclosure of such information to the appropriate professional authority 

8.4  Misconduct It is professional misconduct for a lawyer to:

1. Violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce another to do, or do so through the acts of another:

2. Commit a criminal or deliberately wrongful act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness to practice law;

3. Engage in conduct involving dishonesty, fraud, deceit or misrepresentation which reflects adversely on the lawyer’s fitness to practice law;

4. State or imply an ability to influence improperly or upon irrelevant grounds any tribunal, legislative body, or public official; or

5. Knowingly assists a judge or judicial office in conduct that is a violation of applicable rules of judicial conduct or other law.
